Introduction
Selected family members of a citizen of the Republic of Poland who resides permanently on the territory of the Republic of Poland and regularly travels to another Member State of the European Union for work purposes may apply for a temporary residence permit for a family member of a Citizen of the Republic of Poland if they come from third countries or are stateless and show that failure to grant them this permit will result in the citizen Polish being forced to give up these economic trips or limit them.
A temporary residence permit for a family member of a Citizen of the Republic of Poland is a type of temporary residence permit, i.e., a permit entitling to stay in Poland for a specified period.
In the situation described above, it is granted:
a child of a citizen of the Republic of Poland under 21 years of age
stepdaughter of a citizen of the Republic of Poland (i.e., the child of a person with whom the citizen Polish is married recognized by the law of the Republic of Poland) under the age of 21
a child of a citizen of the Republic of Poland who, although over 21 years of age, is still dependent on them or their spouse
stepchild of a citizen of the Republic of Poland who, despite reaching the age of 21, is still dependent on them or the maintenance of their spouse
a parent of a citizen of the Republic of Poland who is dependent on them spouse
the mother-in-law of a citizen of the Republic of Poland who is dependent on them or their spouse
- if they intend to stay in Poland for a period longer than 3 months.
This permit is granted as an administrative decision by the voivode competent for the foreigner's place of stay, and in the case of appeal proceedings - by the Head of the Office for Foreigners, for the period necessary to achieve the purpose of stay - at least for a period of more than 3 months, but not longer than 1 year.
This permit is not automatically renewed - a foreigner interested in the continuation of stay in Poland before its expiry should apply for a temporary residence permit, e.g. another temporary residence on the same basis and work permit, or an indefinite permit (i.e. a permanent residence permit or an EU long-term resident permit), provided that they meet the requirements for granting it.
