Requirements

In order for a foreigner to be able to obtain a temporary residence permit for victims of human trafficking, it is necessary that the following requirements are met in a cumulative manner:

  • they are people entitled to apply for a temporary residence permit for victims of human trafficking – they are therefore third-country nationals or stateless persons, and at the time of the application they are staying on the territory of the Republic of Poland (excluding stay with m.in on the basis of indefinite permits or temporary residence permits due to circumstances requiring a short stay);

  • fulfil the formal requirements related to the permit, including: submit the application in person, on the form, together with the necessary attachments, and present a valid travel document (or in justified cases, if the foreigner does not have a travel document and it is not possible to obtain it - another a document confirming their identity), will give back fingerprints (except where fingerprinting is not physically possible). The payment of stamp duty in the case of this permit is not required;

  • cooperated with the authority competent to conduct proceedings in the case of the crime of human trafficking, and in the case of a minor foreigner – received the status of an aggrieved party in these proceedings;

  • severed contacts with persons suspected of committing the crime of human trafficking.
