Introduction
Foreigners who have acquired the status of a long-term resident, in accordance with Council Directive 2003/109/EC, in a Member State of the European Union other than Poland, after transferring to Polish may obtain a temporary residence permit.
A temporary residence permits due to other circumstances granted because you have the status of a long-term EU resident in another country is a type of temporary residence permit, i.e., a permit entitling you to stay on the territory of the Republic of Poland for a certain period.
This permit shall be granted in a simplified manner in connection with the declared intention to:
performing work in Poland or conducting business activity on the basis of applicable regulations,
concepts or continuation of studies or vocational training in Poland, or
achieving another goal justifying living in Poland for a period longer than 3 months.
As part of the administrative procedure provided for this permit, a foreigner does not have to demonstrate m.in the advantage of their business activity, does not pass the labour market test and is not subject to detailed restrictions on the choice of university institution, like foreigners applying for temporary residence permits in the usual way due to the above-mentioned purposes. After granting this permit, the foreigner is entitled to perform work in Poland without the need to have a work permit.
This permit is granted in the form of an administrative decision by the voivode, competent for the place of residence of the foreigner, and in the case of appeal proceedings – by the Head of the Office for Foreigners, for the period necessary to implement the volunteering contract – for a minimum period of more than 3 months, but not longer than for a period of 3 years.
This permit is not automatically renewed - a foreigner interested in the continuation of stay in Poland before its expiry should apply for a temporary residence permit, e.g. another temporary residence on the same basis and work permit, or an indefinite permit (i.e. a permanent residence permit or an EU long-term resident permit), provided that they meet the requirements for granting it.
