Introduction
A temporary residence permit due to other circumstances is a type of temporary residence permit, i.e., a permit entitling to stay in Poland temporarily for a specific purpose, granted to third-country nationals (i.e., persons who do not have citizenship of one of the EU countries, Norway, Iceland, Liechtenstein or Switzerland) and stateless persons, regardless of their age, if the main purpose of their stay in Poland is the intention to undertake or continue vocational training, i.e., education aimed at obtaining, supplementing, or improving the skills, professional or general qualifications needed to carry out the work.
The scope of vocational training includes specialized training combining theory with practice, usually certified, and culminating in an examination conferring specific qualifications (allowing the exercise of a profession or specific activities).
The condition for granting the permit is that the education justifies stay in Poland for a period longer than 3 months, and the foreigner has: health insurance, an adequate source of income and a guaranteed place of residence during the stay in Poland.
This permit is granted in the form of an administrative decision by the voivode, competent for the place of stay of the foreigner, and in the case of appeal proceedings – by the Head of the Office for Foreigners, for the period necessary to undergo training, but not longer than for a period of 1 year.
This permit is not automatically renewed – a foreigner interested in continuing their stay in Poland before its expiry should apply for a temporary residence permit, e.g., another temporary residence permits due to other circumstances, or a permanent residence permit, if they meet the requirements necessary to grant it.
[ If you have acquired the status of a long-term EU resident in another EU Member State and you intend to undertake or continue vocational training in Poland, you can apply for a temporary residence permit in a simplified mode – i.e., with a temporary residence permit due to other circumstances referred to in Article 186(1)(3) of the Act on Foreigners. Please read the conditions and procedure for granting this permission. ]
Remember!
This permit does not entitle you to perform work without the need to have a work permit.
The certificate of completion of vocational training in Polish does not confirm the knowledge of the Polish language required to acquire the status of a long-term EU resident.
